Mahoney’s “Road to Fame”

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER. ALL CONTESTANTS MUST BE 21

YEARS OF AGE OR OLDER AND A LEGAL RESIDENT OF THE UNITED STATES. VOID ELSEWHERE AND WHERE PROHIBITED BY LAW.

ELIGIBILITY: This competition (the “Competition”) is only open to legal residents of the United States who are 21 years of age or older. The Competition will be held at Mahoney’s Pub & Grille, located at 551 West Ogden Avenue, Chicago, Illinois (the “Venue”). All employees of the Venue, (“Sponsor”), Lodge Management Group, Big Creek Events, Adams Street Productions, and the immediate family members and those living in the same household of any of the foregoing, are not eligible to enter. Void where prohibited by law. Subject to all applicable federal, state and local laws. Contestant represents that he/she is not under contract with any major or nationally known record label. Sponsor reserves the right to disqualify any contestant that is under contract that Sponsor deems to be a major or nationally known record label, at Sponsor’s sole discretion. Each contestant must be able to produce a valid, government-issued identification upon the request of the Sponsor, and the failure to do so will result in immediate disqualification from the Competition.

TO ENTER:
Beginning on October 1, 2008, at 12:01:01 a.m. Central Standard Time (“CST”) and through November 5, 2008 at 11:59:59 p.m. CST, visit www.MahoneysRoadToFame.com and complete the on-line application. On-line applications will be accepted on a first-come first-serve basis. On-line applications must be submitted by November 4, 2008 at 11:59:59 p.m. CST. Limit one on-line application per person. Released Parties (as defined below) are not responsible for late or incomplete on-line applications, or for technical, hardware, software, or Internet malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in conjunction with this Competition, which may limit the ability to participate, or by any error, human or otherwise, relating to or in connection with this Competition. All on-line applications become
the property of the Sponsor. Any false information provided on an on-line application, or in connection with the Competition will result in immediate disqualification from the Competition. No purchase or fee is necessary to enter the Competition, however, Sponsor reserves the right to charge a fee to enter the Venue (a “cover charge”). Such a cover charge will in no way be construed to be a payment or consideration to enter the Competition.

THE COMPETITION: Contestants will compete against each other through six rounds of the Competition. The Competition will be held at the Venue on the following dates:

Round 1 will include up to 100 contestants judged on the night of November 5, 2008.
Round 2 will include up to 100 contestants judged on the night of November 12, 2008.
Round 3 will include up to 50 contestants judged on the night of November 19, 2008.
Round 4 will include up to 25 contestants judged on the night of November 26, 2008.
Round 5 will include up to 12 contestants judged on the night of December 3, 2008.
Round 6 (the “Final Round”) will include up to 4 contestants judged on December 10, 2008.
The above dates and (exact times which are yet to be determined) are subject to change at the Sponsor’s sole discretion.

JUDGING: Round 1 & 2: A panel of three independent judges will be solely responsible for determining which competitors advance from Round 1& 2 to Round 3. The judges’ decisions will be based upon the following three criteria: (1) Talent, (2) Ability and (3) Style. The judges will award points in each of the three categories on a scale of 1 to 10 (for a maximum possible score of 30 points). In the event of a tie, the contestant with the higher Talent score will advance. In the event of a further tie, the judges, in their sole discretion, will determine which contestant advances.

Round 3 through the Final Round: Those contestants who receive the highest number of audience votes on a given night will advance from Round 3 through the Final Round. Audience voters will consist of those patrons present at the Premises on a given night. At the conclusion of the Competition on a given night, patrons will be instructed to “text” a code to vote for the contestant of their choice. Each Patron may vote up to five times.  In case of a tie during Round 3 through the Final Round, the judges, in their sole discretion, will determine which contestant advances.

NOTIFICATION: Contestants will be notified whether they have advanced to the next round within 48 hours of the end of the previous round by phone or e-mail. Results will also be posted on www.MahoneysRoadToFame.com within 48 hours of the end of the previous round.

PERFORMANCE GUIDELINES: General guidelines relating to all Rounds: Contestants must be able to attend all six rounds of the Competition. No substitutions will be allowed for any contestant. The order of contestants’ performances on each night will be determined by the Venue. Every contestant must be ready to perform when it is his or her turn.  If a Contestant is unable to perform, or does not attend his/her scheduled performance an Alternate will be chosen from the previous round

Guidelines relating specifically to Round 1 through Round 2:
Contestants must sing a cappella, but may choose any song not containing profanity or graphically violent content. A contestant may sing the same song as other contestants on a given night. However, during Round 1 through Round 2, once a contestant performs a song, that contestant may not perform the same song again. Contestants should have at least three songs prepared to sing a cappella. Contestants will have up to three minutes to perform, but judges have the prerogative to end a performance at any time prior to the expiration of those three minutes.

Guidelines relating specifically to Round 3 through the Final Round: Contestants will sing karaoke, and must choose a song from a song list selected by Sponsor in its sole discretion. During Round 3 through the Final Round, contestants may sing a song that he or she performed in Round 1 through Round 2. However, during Round 4 through the Final Round, once a contestant performs a song, that contestant may not perform the same song again. Additionally, during Round 3 through the Final Round, a contestant may not perform a song performed by another contestant on the same night. In order to avoid contestants performing the same song on a given night, each contestant must notify the Sponsor’s designated representative of his or her song choice 24 hours prior to the start of a given Round. Contestants will “Draw Straws” to determine the order of song choice. Contestants will have 3 minutes to perform a song and will not be allowed to start a song over.

GRAND PRIZE:(1): One (1) Grand Prize Winner will be scheduled for a one time performance in the Los Angeles area at  Rush Street (9546 Washington Blvd Culver City, CA 90232). Performance date is January 29th. Performance time is TBA at the sole discretion of Rush Street management. The Performance will consist of 3-5 songs with the support of the Rush Street house musicians. The winner will have a 2 hour rehearsal Day-Of between the hours of 3 and 5pm. The performance will take place before a VIP audience to include several entertainment Agents and Managers, in attendance specifically to view the winner. 
Grand prize also includes airfare for 2 people and hotel accommodations for 2 people for 2 nights (one room) at the Culver Hotel (located near the Rush Street venue), as well as a cash prize of $500.00 and 1 (one) Beta 58A vocal mic (courtesy of Shure Microphones).
The Grand Prize Winner must sign and execute an Affidavit of Eligibility/Liability prior to issuance of the Grand Prize. In the event of noncompliance with these Official Rules, or if the Affidavit of Eligibility/Liability is returned as undeliverable, the Grand Prize will be forfeited and awarded to the runner-up. The Grand Prize is not transferable, except at the sole discretion of the Sponsor.

ADDITIONAL RULES: All contestants release Mahoney’s Pub and Grille and their respective parents, affiliates, subsidiaries, vendors, advertising and promotion agencies, and all others associated with the development and execution of this Competition, and the respective officers, directors, shareholders, and employees of the foregoing (collectively, the “Released Parties”) from any and all liability with respect to/or in any way arising from participation in this Competition or acceptance or use of the Grand Prize including liability for personal injury, damages and loss, and Sponsor’s and its designees use of any materials related to the Competition. Submission of the on-line application constitutes permission for Sponsor or its designees to use any contestant’s name, likeness, photograph, voice, singing voice and biographical information for advertising, publicity and other purposes, in any and all media now or hereafter known, without further notice or compensation. Sponsor reserves all rights, including the right to film, tape and record any contestant’s performance and to edit, publish, use, adapt, exploit, modify or dispose of such film, tape or recording, online, in print, film, television, or in any other media for advertising and promotional or any other purposes without compensation or notification to said contestant. By entering the Competition, the Grand Prize Winner agrees to participate in any promotional events related to the Competition, and failure to do so will result in forfeiture of the Grand Prize. Sponsor reserves the right to cancel or modify these Official Rules for any
reason whatsoever, or if fraud, technical failures, unauthorized intervention or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Competition, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to judge entries from among the eligible, non-suspect entries received up to the time of the impairment. By entering this Competition, contestants accept and agree to abide by these Official Rules and the decisions of the judges, the voting audience and the Sponsor, which shall be final, binding and conclusive on all matters related to the Competition.
